Understanding the Constitution as essential act of a legal system prompts us to seek answers even most difficult questions in it. One them is problem status illegal evidence, use which, although facilitating court proceedings, raises doubts from perspective constitutional principles. Therefore, this study’s task establish such evidence Art. 51.4 Constitution, taking into account theoretical and distinction between norms shaping rules formalization conventionalization activities.
